Terms of Service

Who you are contracting with

These Terms of Service govern your use of Race.Radio at race.radio. The service is provided by Develofi, LLC, a Florida limited liability company, located at 7901 4th St N, Ste 300, St. Petersburg, FL 33702.

B3IP Holdings, Inc. owns the Race.Radio trademarks and the underlying intellectual property and licenses them to Develofi, LLC.

Eligibility

You must be 18 years of age or older to create an account or use Race.Radio.

License to use the service

Subject to these terms, Develofi, LLC grants you a limited, revocable, non-exclusive, non-transferable license to use the service for organizing, announcing, participating in, or following race events.

Prohibited uses

You may not misuse the service, including by: uploading content you have no right to use; cloning a voice without the speaker's consent; impersonating others; tracking people without their permission; interfering with or reverse engineering the service; scraping; or using the service for unlawful, harassing, or deceptive purposes.

Accounts

You are responsible for keeping access to your email and sign-in codes secure and for all activity under your account. Provide accurate information and tell us promptly about any unauthorized use.

Your content

You keep ownership of content you submit, such as runner rosters, announcement text, presets, course data, and voice recordings. You grant Develofi, LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, broadcast, and distribute that content within the service in order to operate it.

You are responsible for your content and for having the rights and consents it requires, including consent from runners whose data you upload and from any person whose voice you clone. We may remove content at our discretion.

Safety and courses

Course routes, rerouting suggestions, hazard markers, GPS positions, and unofficial finish times are aids only. Organizers and course editors are solely responsible for verifying routes, turns, hazards, and results.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEVELOFI, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

Indemnification

You agree to indemnify and hold harmless Develofi, LLC, B3IP Holdings, Inc., and their affiliates from claims arising from your misuse of the service, your content, or your violation of these terms.

Termination

We may suspend or end your access at any time if you violate these terms. You may stop using the service at any time.

Governing law and venue

These terms are governed by the laws of the State of Florida. Exclusive venue for any dispute is the state and federal courts located in St. Johns County, Florida.
